These Terms and Conditions (“Terms”) govern your use of the website www.tombalinaconsulting.com (the “Website”) and any services, content, communications, courses, coaching, webinars or resources made available through it (together, the “Services”). The Website and Services are operated by Heather Elizabeth Crowther a sole trader trading as “Tombalina Consulting” (“we”, “us”, “our”). By accessing or using the Website, joining a waiting list, subscribing to our communications, or otherwise using our Services, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not use the Website or Services.  We recommend that you print or save a copy of these Terms for future reference.

We may update, change, suspend or withdraw all or any part of the Website and Services at our discretion and without notice. We do not guarantee that the Website, or any content on it, will always be available or uninterrupted.

You may view, download and print content from the Website for your own personal, non-commercial use only. You must not:

6. Waiting lists, subscriptions and account information

Where the Website invites you to join a waiting list, register your interest, subscribe to updates, or create an account, you agree to provide accurate, current and complete information and to keep it up to date. Joining a waiting list or registering your interest does not create any obligation on us to provide a particular Service, place, price or date, and does not form a binding contract for the supply of Services unless and until we confirm your booking in writing.

 

7. Our Services and coaching relationship

Tombalina Consulting provides emotional intelligence coaching, education, and related content and resources designed to support personal development and emotional wellbeing.

You acknowledge and agree that:

  • Our Services are educational and developmental in nature and are intended to support self-understanding and personal growth.

  • Our Services are not a substitute for professional medical, psychiatric, psychological, therapeutic, financial or legal advice, diagnosis or treatment. We are not acting as your doctor, therapist, counsellor, or licensed clinician, and nothing on the Website or in our Services should be relied upon as such.

  • If you are experiencing a medical or mental-health emergency, or think you may have a health condition, you should contact a qualified healthcare professional or your local emergency services immediately.

  • Personal development is individual, and we make no representation, warranty or guarantee about any specific outcome or result you will achieve from using our Services. Results depend on many factors outside our control, including your own participation and circumstances.

 

8. Bookings, fees and payment

At the date these Terms were last updated, the Website is primarily used to share information and to collect expressions of interest and email subscriptions. 

Where paid Services are offered:

  • The price, scope and any specific terms of the Service will be described at the point of purchase or in a separate agreement, which will apply in addition to these Terms.

  • Payments may be processed by a third-party payment provider. You agree to comply with the relevant payment provider’s terms, and you are responsible for providing accurate payment information.

  • All prices are stated inclusive or exclusive of applicable taxes as indicated at the point of sale.

9. Cancellations and refunds

Where you purchase paid Services as a consumer, you may have statutory cancellation rights. For digital content and services supplied online, these rights can be affected once performance has begun or once you have accessed digital content, in accordance with applicable consumer protection law. Your specific cancellation and refund rights for each paid Service will be set out at the point of purchase.

If you subscribe to our updates, join a waiting list, or otherwise consent to receive communications from us, we will send you emails relating to our Services, content and offers. You can withdraw your consent and unsubscribe at any time using the unsubscribe link in any email, or by contacting us at info@tombalinaconsulting.com .   • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with any coaching and advice received, during or after the use of any products, services or coaching advice offered through service or website products.

  • We will not be liable for any loss of profits, loss of business, business interruption, or loss of business opportunity.

  • Our total liability to you for all losses arising under or in connection with your use of the Website or any free content shall not exceed £100, except where otherwise agreed in a separate written agreement for paid Services.

Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any paid Services to you, which will be set out in the applicable terms for those Services.

14. Indemnity

You agree to indemnify and hold us harmless from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your misuse of the Website or Services.

These Terms, their subject matter and their formation are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have jurisdiction, except that if you are a consumer resident in another jurisdiction, you may also be entitled to bring proceedings in, and benefit from any mandatory protections of, your country of residence.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
